New Jersey Statutes Appendix - Former Title 3A Administration of Estates Decedents and Others 3A § 7-21

Except where otherwise provided by law, when the bond of a fiduciary given to any court or to any judicial officer or clerk of any court, for the faithful performance, by him, of the duties of his office as such fiduciary, is forfeited, said bond may, without leave of any court, be prosecuted in any court of record by, and at the expense of, an aggrieved party and in the name of the state at the relation of such aggrieved party.
