No such order shall be made in cases in which the fiduciary is an executor, administrator with the will annexed, substituted administrator with the will annexed, administrator or substituted administrator except upon proof that 6 months have elapsed after the entry of an order to limit creditors pursuant to section 3A:24-3 of this title, and that there are not unpaid or pending any claims of creditors of the decedent presented to the fiduciary pursuant to chapter 24 of this title.
