If a person restored to reason shall not execute the release or relinquishment provided by section 3A:38-5 of this title, the court may ascertain and determine a sum in gross to be paid to such person in satisfaction of his or her inchoate right or estate and may direct that the same be paid to him or her and that any and all other money or property that may have been paid to the guardian of such person, or have been retained to provide for the payment of such curtesy or dower right or estate, be paid to the persons thereto entitled as the court may ascertain and determine.
