If after the institution of any action in any court of this state a party thereto dies resident in a jurisdiction outside of this state and the claim upon which said action is based is not extinguished by his death, his executor or administrator by virtue of letters of authority received in that jurisdiction may join in or be made a party to the action before or after the judgment, as if his letters had been granted in this state; provided that pending or subsequent to the action, an exemplified copy of his letters is filed in the office of the clerk of the court or, if the action affects real estate in any county of this state, then either in the office of the clerk of the superior court or the office of the surrogate of that county.
