Any fiduciary by virtue of letters or authority obtained in a jurisdiction outside of this state upon the estate of any person who died a resident of such jurisdiction, or as to any ward resident therein or trust established under the laws thereof, may maintain, or be made a party defendant to, any action which is to be commenced in any court of this state, as if his letters had been granted in this state; provided that prior to, pending or subsequent to the action, an exemplified copy of his letters or authority is filed in the office of the clerk of the superior court or, if the action affects real estate in any county of this state, then either in said office or the office of the surrogate of that county.
