(a) A person commits an offense if the person solicits for or organizes a lodge of a fraternal benefit society without first obtaining from the commissioner a certificate of authority that entitles the society to engage in business in this state.
(b) An offense under this section is a misdemeanor punishable by:
(1) a fine of not less than $100 or more than $250;
(2) confinement in jail for not less than three months or more than six months; or
(3) both a fine and confinement.
