(a) The department may suspend or revoke the temporary appointment powers of an agent, insurer, or health maintenance organization if, after notice and opportunity for hearing, the department determines that the agent, insurer, or health maintenance organization has abused the temporary appointment powers.
(b) In determining whether abuse has occurred, the department may consider:
(1) the number of temporary appointments made;
(2) the percentage of appointees taking the examination required for licensing as an agent, as provided by Section 4001.161; and
(3) the number of appointees who pass the examination.
