Section 1. The functions, powers and duties of the Department of Labor and Industry with regard to the storage and possession of explosives, as set forth in the act of July 1, 1937 (P.L. 2681, No. 537), entitled “An act relating to, and regulating the manufacture, storing, and possession of explosives; requiring permits for magazines, and prescribing permit fees; and providing penalties,” 1 are hereby transferred to the Department of Environmental Resources.
Section 2. All the functions, powers and duties of the Department of Labor and Industry as set forth in the act of July 10, 1957 (P.L. 685, No. 362), entitled “An act regulating the use of explosives in certain blasting operations; requiring examination and licensing of certain explosives' detonators and prescribing the fee thereof; and conferring powers and imposing duties on the Department of Labor and Industry,” 2 are hereby transferred to the Department of Environmental Resources.
Section 3. There are hereby transferred from the Department of Labor and Industry to the Department of Environmental Resources to be used, employed and expended in connection with the functions, powers and duties transferred by sections 1 and 2 of this Reorganization Plan all contract obligations (if any), all records, files, property, supplies and equipment being used or held in connection with such functions, powers and duties.
Section 4. The listed acts in sections 1 and 2 of this Reorganization Plan or any pertinent parts thereof are suspended insofar as they are in conflict with this Reorganization Plan.
