Every master, officer, or other person, or persons, having charge of any vessel navigating the Delaware River and its navigable tributaries, who shall violate any rule regulating the speed of vessels, made and promulgated by the said commissioners, he or they, so offending, shall forfeit and pay a sum not exceeding fifty dollars for the first offense, and not less than seventy-five dollars nor more than one hundred dollars for each subsequent offense; to be sued for and recovered, with costs of suit, by the president of said commissioners, for the use of the Commonwealth, before any magistrate of the city of Philadelphia, alderman, or justice of the peace 1 of the proper county.
