The violation of any of the provisions of this act shall subject all persons, firms or corporations, so offending, to a penalty not exceeding one hundred dollars for each and every offense, to be recovered summarily before any magistrate or court having jurisdiction, and which penalty, when recovered, shall be paid into the treasury of such cities. All actions for penalties, however, shall be in the name and for the use of such city.
