Pennsylvania Statutes Title 53 P.S. Municipal and Quasi-Municipal Corporations § 18112. Applicability

(a) Existing commercial business improvement districts.--The provisions of this act shall not apply to a business improvement district established pursuant to the act of May 2, 1945 (P.L. 382, No. 164),  1 known as the Municipality Authorities Act of 1945, in existence in whole or in part in a city of the first class prior to the effective date of this act.

(b) Existing districts.--Except as provided for in subsection (e), any existing business improvement district or downtown improvement district established prior to the effective date of this act shall remain in existence and shall be governed by the Municipality Authorities Act of 1945 insofar as it relates to business improvement districts or 53 Pa.C.S. Ch. 54 (relating to business improvement districts).

(c), (d) Deleted by 2016, May 24, P.L. 220, No. 28, § 4, effective in 60 days [July 25, 2016].

(e) Requirements.--A business improvement district may be established or continued pursuant to provisions of this act or the provisions of the Municipality Authorities Act of 1945, insofar as it relates to business improvement districts.  Any business improvement district or downtown improvement district established under the Municipality Authorities Act of 1945, insofar as it relates to business improvement districts, shall possess any additional power given to NIDs under this act without having to restructure or reorganize under this act.
