If any person shall, on or after the first Monday of July next, maintain, or keep in use, or operation, or shall thereafter put in use, or operation, any stationary steam engine, or steam boiler, within the said city of Philadelphia, without having first received a certificate that the same has been found to be safe and competent, as is hereinbefore provided for, or shall put, or keep, in use, or operation, any such stationary steam engine, or steam boilers, within the said city, after notice from the said inspector that the same is not competent and safe, he, or she, so offending, shall be deemed guilty of a misdemeanor, and, upon conviction in the court of quarter sessions for the said county, shall be sentenced to pay a fine not exceeding five thousand dollars, and to undergo imprisonment in the jail of said county, either with, or without, labor, as the court may direct, for a term not exceeding two years; and each and every such person shall be liable for all damages that may accrue directly, or indirectly to any person, or persons, whatever.
