Any person or persons erecting and maintaining the fence or structure, described in section one hereof 1 as unlawful and prohibited, shall be deemed guilty of a misdemeanor, and, if convicted thereof, shall be punished by a fine of not less than fifty dollars nor more than two hundred dollars, or by imprisonment in the county jail for not less than thirty days or not more than six months, or by both fine and imprisonment to said respective amount and extent, at the discretion of the trial judge.
