No IRO, clinical reviewer working on behalf of an IRO or an employee, agent or contractor of an IRO may be held liable for damages to a person for an opinion rendered, or act or omission performed, within the scope of the organization's or person's duties under the law during or upon completion of an external review conducted under section 2162 1 or this subdivision, unless the opinion was rendered, or act or omission performed, in bad faith or involved gross negligence.
