(a) Violation of Health Care Facilities Act.--The failure of a health care facility to report health care-associated infections as required by sections 404 and 405 1 or the failure of a health care facility or ambulatory surgical facility to develop, implement and comply with its infection control plan in accordance with the requirements of section 403 2 shall be a violation of the Health Care Facilities Act.
(b) Administrative penalty.--In addition to any penalty that may be imposed under the Health Care Facilities Act, a health care facility which negligently fails to report a health care-associated infection as required under this chapter may be subject to an administrative penalty of $1,000 per day imposed by the department.
