Provided, 1. That the fees and charges of maintenance due to the jailer at the time of the discharge of the debtor, being approved by the court, shall be first paid out of the debtor's property, previous to any distribution: And provided, 2. That no preference shall be allowed to debts due on specialties, but all bona fide mortgages, judgments and executions, binding the real or personal estate of such insolvent, shall remain good and effectual in law, and shall be first satisfied out of the debtor's estate, according to their priority of lien.
