(a) The commissioner may by order defer admissions to any facility in the department when the total number of patients therein exceeds its capacity to an extent which will not permit adequate care and treatment to be provided patients.
(b) If the commissioner shall determine that overcrowding exists in the department schools, he may, within the amounts appropriated therefor, authorize admission for care and treatment of any person with a developmental disability to a designated facility approved for such purposes by the commissioner. The patient and any liable relatives shall be liable for payment of fees in accordance with article forty-three of this chapter.
