New York Consolidated Laws, Judiciary Law - JUD § 101. Power of justices of appellate division of second department to appoint clerical and other personnel of the appellate term

The justices of the appellate division of the supreme court in the second department, or a majority of them, are authorized to appoint in their discretion, and to remove at pleasure, for the appellate term of the supreme court in the second department, a chief clerk, one deputy clerk, one assistant deputy clerk, and all necessary other assistants and personnel in said court, and to prescribe the duties and fix the salaries thereof.  Except as provided in the state finance law, such salaries and all other necessary expenses of such appellate term, shall be paid by the state comptroller out of moneys appropriated therefor by law.  The state department of taxation and finance shall pay such salaries in equal biweekly installments and shall apportion the total amount of such salaries and expenses among the counties comprising the second judicial department.  Such counties shall reimburse the state for such salaries and expenses.  The time and method of such reimbursement shall be as specified in section seventy-four of this chapter.  1
