1. The mayor of the city of New York shall establish a procedure for determining whether an employee of such city enforcing certain regulations in such city suffered an injury in performance of his or her duties as a result of the commission of any of the following offenses: assault as defined in article one hundred twenty of the penal law, 1 menacing as defined in section 120.15 of such law or harassment as defined in subdivision one of section 240.25 of such law. Provided, however, that such procedure shall not be heard in the first instance or reviewed subsequently thereto by an officer, employee or agent of the department in which such employee is employed.
2. For the purposes of this section, an employee of the city of New York responsible for enforcing certain regulations in such city shall mean a traffic enforcement agent or an employee of the department of sanitation who is authorized to issue notices of violation, summons or appearance tickets.
