“Children's product” means a consumer product that is designed or intended:
1. For the care of or use by a child under 12 years of age; or
2. To come into physical contact with a child under 12 years of age at the time the product is used.
For the purposes of this subsection, “children's product” does not include soap or any medication, drug, food or other product that is intended to be ingested or that is regulated by the Food and Drug Administration of the United States Department of Health and Human Services.
