In all other cases of crimes the prisoner may be taken before any magistrate authorized to issue a warrant, who shall proceed as soon as may be to examine the complainant and witnesses for the prosecution, on oath, in the presence of the prisoner, with regard to the offense; after the examination of the witnesses for the prosecution, the witnesses for the defense shall be sworn and examined.
