New Jersey Statutes Title 40. Municipalities and Counties 40 § 49-16

After hearings held upon notice, in the manner provided in chapter 56 of this title (§ 40:56-1 et seq.), in case of assessment for benefits and awards for incidental damages where no lands are taken, they shall make an award to the owner for the real estate or right or interest therein to be taken and the damage done to the remaining property, if any.  They shall then assess the probable net cost upon the land to be specially benefited in proportion to the benefit to be received.
