Where the value of the real estate of any minor shall not exceed $100 and the value of the personal estate of any minor shall not exceed $1,000, either parent of the minor or a person standing in loco parentis to the minor shall be entitled to receive the same for the benefit of the minor without being appointed guardian or entering into bond, upon the execution of the affidavit herein provided for, before the surrogate of the county where the minor resides or if nonresident in this state, where any of the assets are located, or before the superior court. The affidavit shall set forth that the value of the minor's real estate will not exceed $100 and the value of his personal estate will not exceed $1,000, and shall state the residence of the minor and specifically the nature, location and value of said assets, and that:
a. affiant is the minor's parent and that the other parent has consented to such receipt, or is dead, or has absconded, or has absented himself leaving the minor without sufficient provisions for maintenance and education, or is in the armed forces of the United States, or is not present in the continental United States, or
b. affiant is a person standing in loco parentis to the minor, and that the minor's parents have consented to such receipt, or are dead, or have absconded, or have absented themselves leaving the minor without sufficient provision for maintenance and education, or are in such armed forces, or are not present in the continental United States, as the case may be.
