New Jersey Statutes Appendix - Former Title 3A Administration of Estates Decedents and Others 3A § 4-2

The real property shall descend to the intestate's children and such persons as legally represent any child who may have died, subject to the rights or estate of the intestate's husband or widow, as the case may be, under curtesy or dower or any marriage settlement.

One-third of the personal property shall be distributed to the intestate's husband or widow, as the case may be, and the residue in equal portions among the intestate's children and such persons as legally represent any child who may have died.
