If a release, conveyance or mortgage is directed by the court, a bond shall be given by the owner of the real estate to the superior court or to the guardian of the incapacitated person in such penalty and with such surety as the court may direct, to secure to the person so entitled to a right or estate of curtesy or dower consummate, the enjoyment during his or her life of a fund equal to such an amount of the whole proceeds of the sale or other conveyance of real estate, or of their value, as will equal the amount of curtesy or dower to which he or she shall be entitled at the time when his or her right or estate vested, or, if the curtesy or dower interest be inchoate, to secure the enjoyment of such fund to the person so entitled during his or her life, after the same becomes consummate.
