If it appears in such an action that the surplus of assets in the hands of the executor
or administrator with the will annexed over debts of the testator, is sufficient to
pay all legacies bequeathed, the full amount of the legacy may be recovered with costs;
but if the surplus is not sufficient therefor, an abatement shall be made in proportion
to the legacies so given.
