New Jersey Statutes Appendix - Former Title 3A Administration of Estates Decedents and Others 3A § 24-40

If upon such an adjudication and determination, it appears to the court that the real and personal estate is insufficient to pay the debts, or whenever it appears to the satisfaction of the court, upon consideration of the claims of creditors and the amount of the real and personal estate and the value thereof that the real and personal estate is insufficient to pay the debts and that the estate is likely to be insolvent, the court may enter judgment to this effect, and direct the executor or administrator to proceed as if the estate were insolvent, and to make sale of the whole or any part of the real estate of his decedent, from time to time, as may appear expedient, in the same manner as an executor or administrator who is directed to sell real estate under article 6 of this chapter (3A:24-19 et seq.).
