Whenever the state treasurer shall make payment to any person or persons in accordance with the declaratory judgment, as aforesaid, no recovery may be had against the state treasurer by any other person or persons who may thereafter establish in any court proceeding his or their contrary interest or interests in the surplus or the real estate from the sale of which such surplus arose. However, such other person or persons who may thereafter establish in any court proceeding his or their contrary interest therein shall, as to the portion of such surplus remaining in the state treasurer's hands, be entitled to his or their proportionate share thereof and, in addition thereto, may bring an action or actions at law against such persons to whom distribution has been made by the state treasurer, to recover his or their proportionate share of that portion of the surplus so distributed by the state treasurer.
