New Jersey Statutes Appendix - Former Title 3A Administration of Estates Decedents and Others 3A § 24-28

When proceeds of sale are insufficient to pay the mortgage or judgment debt in full, any balance remaining due shall be a claim against the other assets in the hands of the executor or administrator, and as to such balance, a mortgage holder shall be entitled to payment pro rata with claims of other creditors, and a judgment lien holder shall have such priority as he may be entitled to by law.
