In an action brought for the sale of real estate to pay debts, the court to which an executor or administrator is accountable shall, if satisfied that the personal estate of the decedent is insufficient to pay debts, direct the sale of so much of the real estate as will be sufficient to pay the residue of the debts remaining after the executor or administrator shall have applied the personal estate, or so much thereof as shall have come to his hands.
If he is accountable to a county court, then the court to which he is accountable may direct the sale, notwithstanding that the real estate may be situated in any other county; but where the real estate is so situated, a certified copy of the proceedings in the action shall be recorded in such other county.
