When a decedent has made an agreement for the conveyance of real estate within this state, and the purchaser has paid therefor in full or in part and has been placed in possession thereof by the decedent, or when a decedent has made a contract in writing for such conveyance, the superior court, or the county court of the county wherein the real estate is situate, in an action brought for that purpose may direct the executor, administrator, administrator with the will annexed, substituted administrator, substituted administrator with the will annexed, or administrator pendente lite of the decedent, and the purchaser, his personal representatives, and successors in interest or assigns, to fulfill the contract or agreement according to its terms and to execute a good and sufficient conveyance to the purchaser or his successors and assigns.
An action to secure such direction from the court must be commenced within 3 years from the date of the decedent's death.
