When, during his lifetime a decedent shall have received a conveyance of real estate in trust for another or shall have executed a declaration of trust for the same setting forth in effect that he has no beneficial interest therein and holds it for the use of or subject to the order of another in the declaration named, and the decedent shall die without making a conveyance of the real estate to the person thereto entitled, the superior court or the court to which the fiduciary is accountable may, upon application of the executor or administrator of the decedent, authorize such executor or administrator to convey the real estate pursuant to stipulations contained in the declaration of trust.
