If an action shall be pending in any court of this state, having for its object the adjudication of the right, title, claim or other interest of any person or persons in the estate of a decedent, and it shall satisfactorily appear to the court to which the fiduciary of the estate is accountable, that real, personal, or other property of such decedent, or any part thereof, is of such a character or so situated as to make it liable to depreciate in value or deteriorate, pending the final determination of the action, or to make its care or preservation difficult or expensive, or that, for any other reason, the interest of all parties requires or will be benefited by a sale, exchange or other disposition of such property, or any part thereof, pending such determination, the latter court may direct the fiduciary, whether or not he is vested with power of sale under the will, if any, of such decedent, to make sale, exchange or other disposition of such property, or any part thereof, in such manner, for such price, upon such terms, and with such restrictions as shall be deemed proper. From and after the sale, exchange or other disposition, the proceeds thereof or the property received in exchange therefor, shall be held by the fiduciary pending the final determination of such action, in the place and stead of such property, and shall remain subject to the same claims and equities of the parties to such action and of the persons having an actual or asserted interest in the property as was the property. The proceeds resulting from the sale, exchange or other disposition of real estate, or any part thereof, shall be considered as real estate for all purposes, unless otherwise provided in decedent's will.
