1. Each state shall proceed forthwith to acquire title to and possession of the land, easements, rights and interests in real estate or any land under water within its territorial limits which are determined by the commissions to be necessary for the construction of the tunnel or tunnels. Such acquisition shall be in the manner provided for by the law of the state wherein such land, easement, right or interest is located. The cost thereof and the expense of acquisition thereof shall be a part of the cost of construction of the tunnel or tunnels and so charged to the construction account and shall be borne equally by the two states. All titles, rights, easements and interests so acquired shall be owned jointly by the parties hereto as tenants in common and neither state shall alienate its interests therein without the consent of the other.
