1. If either state shall levy or permit to be levied by any political subdivision thereof any taxes, or assessments upon the said tunnel, or tunnels, the property acquired for the construction, operation, maintenance or repair of the said tunnel or tunnels, or upon any income derived from the operation thereof, such taxes or assessments shall be paid out of that part or share of the income derived from such operation which may be or become due or owing to or be in the possession of the state which shall have levied such taxes or assessments or shall have so permitted such taxes or assessments to be levied.
