1. The state house commission, acting for and on behalf of the state of New Jersey, is hereby authorized and empowered to sell the lands and buildings used as the New Jersey Home for Disabled Soldiers, located in the town of Kearny, in the county of Hudson. The state house commission shall invite, by public advertisement, sealed proposals or bids for said lands and buildings, which advertisements shall be published in at least three newspapers in this state for at least three weeks, once each week, in which advertisement shall be fixed a time and place for the reception of said bids, and which advertisement shall contain a description of the lands and premises to be sold; and if, in the judgment of the state house commission a bid shall be received which shall be satisfactory the commission acting for the state shall make and execute an appropriate deed therefor, signed by all the members of the commission, and convey such lands to the purchaser upon the receipt of the purchase price. Should the highest bid or bids received in accordance with the foregoing provisions of this act be deemed unsatisfactory in amount by the state house commission, the said commission may thereafter sell the aforesaid lands and buildings at private sale; provided, however, that such private sale and transfer of the property shall not be made for an amount that is less than the amount of the highest bid or bids that may have been received by virtue of the public advertisements, as hereinbefore provided for. The proceeds of the sale from the said lands and buildings shall be paid into the treasury of the state, and shall be kept therein as a separate fund, which shall be used by the state department of institutions and agencies for the construction of a New Jersey home for disabled soldiers of all wars, to be located in the area north of the city of Trenton; provided, however, the said sale shall not take place until such time as the new home shall be completed and ready for occupancy by the members of said Kearny home.
