1. Whenever in, during or after the construction of any road constructed under the act above entitled, or any supplement thereto or amendment thereof, the board of chosen freeholders discovers that the drainage system is imperfect in any part thereof, and that in order to correct and improve the system and properly carry off the surface water, it is necessary to drain through private property, it shall and may be lawful for such board to improve and construct a drainage system through, over and upon private property; and if the owner or owners of such private property will not make a gift or grant of such rights to such board, or the owner or owners cannot agree with such board as to the value of the lands taken and damages to the remainder, then such board may proceed to condemn such lands in the manner laid down in the act to which this is a supplement or any supplement thereto or amendment thereof.
