4. In case the title of any such board of chosen freeholders to any lands acquired or to be hereafter acquired under the provisions of the act above entitled or any supplement thereto or amendment thereof, should be encumbered or defective and any such board cannot agree with the encumbrancer or owner thereof as to the sum to be paid for a release or the purchase price, then it shall and may be lawful for any such board to take proceedings for the condemnation of such lands under the act above entitled and the supplements thereto and amendments thereof; and the right of any such board to proceed by condemnation under the act aforesaid and the supplements thereto and amendments thereof, shall not be considered as exhausted as to any particular road constructed thereunder until such board shall have proper title thereto and each and every part thereof free from all encumbrances.
