(1) If at least 40% of all qualified electors vote in favor of creating a district, the board of county commissioners of each affected county shall, by an order entered on its minutes, declare the territory enclosed within the proposed boundaries duly organized as a county water and/or sewer district under the name designated.
(2) The election administrator of each county in which the district lies shall immediately file with the secretary of state and the office of the clerk and recorder of the county a certificate stating that the proposition was adopted.
