1. If a county or municipality fails to remit a repayment of assistance provided from the wastewater loan fund within sixty days of the due date of the repayment, the department of natural resources may notify the director of the department of revenue. Upon receipt of such notice, the director of the department of revenue shall deduct such repayment amount from the next and succeeding regular apportionments of local sales tax distributions to that jurisdiction. Such deducted amounts shall immediately be deposited in the wastewater loan fund.
2. The commission shall require that an agreement be established between the department of natural resources and the county or municipality detailing the percentage of the repayment amount to be withheld from each sales tax fund for each county or municipality by the department of revenue under this section.
