Subdivision 1. Conviction. When a person is convicted of an offense undersection 116.28any cleaning agent or chemical water conditioner seized in accordance withsections 116.21to116.35is forfeited to the Pollution Control Agency and shall be disposed of as it directs.
Subd. 2. Consent. When a cleaning agent or chemical water conditioner is seized undersections 116.21to116.35, the owner or the person in whose possession it was at the time of seizure consents in writing to its destruction, it is forfeited to the Pollution Control Agency and shall be disposed of as it directs.
