(a) The commissioner must enforcesections 115A.144to115A.1463as provided under this section andsections 115.071and116.072. The commissioner may revoke a registration of a producer responsibility organization or service provider found to have violatedsections 115A.144to115A.1463.
(b) Notwithstanding the penalty limits contained insection 115.071, subdivision 3, and except as otherwise provided in paragraph (c), a person that violates or fails to perform a duty imposed bysections 115A.144to115A.1463or any rule adopted thereunder is liable for a civil penalty not to exceed $25,000 per day of violation.
(c) Notwithstanding the penalty limits contained insection 115.071, subdivision 3, a producer responsibility organization or producer that violates a provision of or fails to perform a duty imposed bysections 115A.144to115A.1463, a rule adopted thereunder, or requirements of a stewardship plan approved by the commissioner, is liable for a civil penalty not to exceed $25,000 per day of violation. For a second violation occurring within five years after the approval of a stewardship plan, a producer responsibility organization or producer is liable for a civil penalty not to exceed $50,000 per day of violation. For a third or subsequent violation occurring within five years after the approval of a stewardship plan, a producer responsibility organization or producer is liable for a civil penalty not to exceed $100,000 per day of violation.
