Food, beverage and ingredients processed and prepared in commissaries outside the commonwealth may be sold in a vending machine within the commonwealth, if such commissaries conform to the provisions of law governing commissaries within the commonwealth, provided that the operator of said vending machine is licensed under the provisions of section three hundred and nine.
To determine the extent of compliance with such provisions, the commissioner may accept reports from the responsible authority in such jurisdictions outside the commonwealth where such commissaries are located.
