Massachusetts General Laws Part I. Administration of the Government (Ch. 1-182) Ch. 91, § 49A

If a whale or other mammal is deposited or remains in the tidewaters or on the shores of the commonwealth, the department shall, if it determines that said whale or other mammal is or may be injurious to the public health, remove or cause to be removed therefrom such whale or other mammal.
