There shall be established and set up on the books of the commonwealth a separate fund to be known as the Massachusetts Environmental Police Trust Fund which shall be administered by the secretary of energy and environmental affairs. The fund shall be credited with: (i) all revenues collected from the administrative surcharges imposed by section 10I of chapter 21A and section 39 of chapter 90B; (ii) a 10 per cent maintenance fee charged on all division of law enforcement private details which shall be separate from any other administrative fees charged on private details; (iii) any appropriations, bond proceeds or other monies authorized by the general court and specifically designated to be credited to the fund; (iv) interest or investment earnings on any such monies; and (v) all other amounts credited or transferred to the fund from any other fund or source. Amounts credited to the fund may be expended, without further appropriation, by the secretary on programs and costs related to the division of law enforcement including, but not limited to: (1) the expenses of hiring, equipping and training environmental police recruits; and (2) maintenance expenses of the office. The unexpended balance in the fund at the end of a fiscal year shall not revert to the General Fund but shall remain available for expenditure in subsequent fiscal years. No expenditure made from the fund shall cause the fund to become deficient at any point; provided, however, that the secretary of energy and environmental affairs shall report annually, not later than January 15, to the house and senate committees on ways and means and the joint committee on environment, natural resources and agriculture relative to the source and amount of funds deposited into the fund, the amounts distributed and the purpose of any expenditures from the fund.
