The department shall keep and maintain a record of filing fees charged under section ten, penalties levied under section seven and section eight, and attorneys' fees ordered under section thirteen A, where such filing fees, penalties, or attorneys' fees are required to be paid by insurers, separately identifying those amounts which may not be utilized in the establishment of premium rates. This information shall be provided to the advisory council and to the commissioner of insurance at least once each calendar year.
