It shall be unlawful to sell or offer for sale any fabric or related material or finished piece of clothing which is designed to be used in the manufacture, or sold as items, of children's sleepwear up to and including size 14, when such fabric or related material or finished piece of clothing shall be defined as “Flammable” under the provisions of chapter ninety-four B. Whoever himself or by his servant or agent, violates any provision of this section shall, for the first offense, be punished by a fine of not less than fifty nor more than two hundred dollars; and, for the second or subsequent offense, by a fine of not less than two hundred nor more than one thousand dollars, or by imprisonment for not more than ninety days, or both.
