Sec. 301. This chapter does not apply to the following:
(1) A federally insured depository financial institution, which may provide earned wage access services in Indiana without obtaining a license under this chapter.
(2) An individual employed by:
(A) a licensee; or
(B) a person exempt from the licensing requirements of this chapter;
when acting within the scope of employment and under the supervision of the licensee or exempt person as an employee and not as an independent contractor.
(3) An employer that offers a portion of salary, wages, compensation, or other income directly to its employees or independent contractors before the normally scheduled pay date.
