§ 9.20. Condemnation proceeding expenses. The owner of property to be acquired by the Authority shall be reimbursed for any reasonable expenses, including reasonable attorney, appraisal, and engineering fees, that the owner actually incurred because of a condemnation proceeding if:
(1) the final judgement of the court is that the Authority cannot acquire the property by condemnation; or
(2) the condemnation proceeding is abandoned by the Authority other than under an agreed-upon settlement.
