(a) A military magistrate shall be a commissioned officer of the state military forces who is:
(1) A member of the bar of the highest court of this State; and
(2) Certified to be qualified, by reason of education, training, experience, and judicial temperament, for duty as a military magistrate by the senior force judge advocate of the force that the officer is a member.
(b) In accordance with rules adopted by the governor or adjutant general, in addition to duties when designated under section 124B-52, a military magistrate may be assigned to perform other duties of a nonjudicial nature.
